Defendant Fred Davis a/k/a Fred Domino was charged by bill of information on 28 March 1989 with a violation of La.R.S. 40:967, distribution of cocaine. Defendant's first trial was declared a mistrial. After a second trial by a twelve member jury he was found guilty as charged on 6 September 1989.
