This civil rights suit alleging claims for the violation of Plaintiff's First, Fourth, Eighth and Fourteenth Amendment rights requires the Court to address several difficult issues of law which are unresolved in this District. First, I must determine the appropriate legal standard to be applied to a claim for post-conviction malicious prosecution in the wake of the Third Circuit's decision in Torres v. McLaughlin,
