Steven Thomas WATERS v. COMMONWEALTH of Virginia.

Court of Appeals of Virginia, Norfolk.

February 2, 1999.

Attorney(s) appearing for the Case

Sydney K.L. West, Gloucester (Horne, West and McMurtrie, P.C., Alexandria, on brief), for appellant.

Robert H. Anderson, III, Assistant Attorney General (Mark L. Earley, Attorney General, on brief), for appellee.

Present: BENTON and ANNUNZIATA, JJ., and OVERTON, Senior Judge.

BENTON, Judge.
