Edward Farren appealed his convictions of driving under the influence (second offense) and refusing to submit to a breath or blood test in violation of Code §§ 18.2-266 and 18.2-268.3. He contends the trial court erred: (1) by refusing to recuse himself, (2) by allowing the Commonwealth to make a final argument after it waived closing, and (3) by finding the evidence was sufficient to convict.
