This criminal appeal arises from the Third Judicial District Court, Parish of Lincoln, the Honorable R. Wayne Smith presiding. The defendant, Robert G. Drake, Jr. was convicted by bench trial of possession of marijuana with intent to distribute, in violation of LSA-R.S. 40:966. The defendant filed a motion to suppress, which was heard and denied by the trial court. Thereafter, the defendant entered a Crosby plea in exchange for a seven-year sentence...
