Plaintiff1 appeals by leave granted the order granting summary disposition in favor of defendants pursuant to MCR 2.116(C)(10) in this action for malicious prosecution. The trial court granted the motion on the basis that plaintiff could not show that the underlying criminal proceeding had terminated in favor of plaintiff. We reverse and remand.
