This matter is before the Court on Defendant Judge Dywan's Motion to Dismiss and For Entry of Final Judgment, filed on October 28, 1998, and Plaintiff's Verified Motion for Disqualification of the Honorable Judge Rudy Lozano, filed on December 18, 1998.
