Rodriguez, a Cuban citizen, filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241 on April 15, 1998, claiming that he is being wrongfully incarcerated pending resolution of his deportation proceedings. (Doc. 1). United States Magistrate Judge Thomas M. Blewitt issued a Report and Recommendation on April 30, 1999, recommending that Rodriguez's petition for a writ of habeas corpus be dismissed...
