I. Background

Following a jury trial, defendant Wal-Mart Stores, Inc. ("Wal-Mart") was found to be 93% liable for injuries sustained by plaintiff Antoinette Ragona when she was struck by a falling vacuum cleaner in defendant's store. Mrs. Ragona was found to be 7% liable for her own injuries. The jury returned a verdict in favor of plaintiffs...
