RULING ON CROSS-MOTIONS FOR SUMMARY JUDGMENT

POLOZOLA, Chief Judge.

This matter is before the Court on cross-motions for summary judgment1 filed by Charlotte S. Provenza ("plaintiff") and defendant Woman's Hospital Foundation ("Woman's Hospital").2 For reasons which follow, the plaintiff's motion for summary judgment shall be granted and defendant's motion for summary judgment is denied.
