LEWIS, J.:

Defendant appeals from the order of the trial court refusing to suppress evidence. The evidence in question was found in a residence in plain view of officers who were in the residence to execute a writ of assistance.

The home in which the evidence was found had been mortgaged to a financial institution. Defendant became delinquent in payment of the note which was secured by the mortgage. In due time, the financial institution which held the mortgage...
