This negligence action arose out of an automobile accident that occurred on 14 October 1993. Plaintiff's testate, Bertha C. Spivery, was a passenger in the front seat of an automobile being driven by her daughter, Denise Holder, in a westerly direction on New Bern Avenue. Defendant Dorothy Galloway Jones was driving south on Trawick Road to the intersection of New Bern Avenue. At that point New Bern Avenue is a divided highway with two lanes for eastbound...
