Plaintiffs Stephen Swanberg and J. Frank Dubberly, owners of a 300-foot by 900-foot parcel of real property located in Tybee Island, Georgia, brought a declaratory judgment action to determine ownership rights in a 150-foot wide right-of-way (formerly a portion of U.S. Highway 80), which abuts plaintiffs' property to the north. Defendant City of Tybee Island counterclaimed seeking a determination of title in its favor. The parties filed cross-motions...
