On 23 March 1995, plaintiff Bruce Vogl as an employee of Sheet Metal Specialties worked on a press brake manufactured by LVD Corporation ("LVD") when the material that he was handling misgaged causing his hand to go into the machine. The resulting crushing injury led to the amputation of four fingers.
