Charles B. Guthrie, appellant herein and defendant below, (hereinafter "Mr. Guthrie"), appeals his conviction of sexual assault of his spouse.1 The Circuit Court of Kanawha County sentenced Mr. Guthrie to two to ten years' imprisonment in the State penitentiary.
