On December 6, 1996, defendant was charged with driving under the influence in violation of OCGA § 40-6-391 and also with weaving over the roadway in violation of OCGA § 40-6-48. Chemical testing of her breath on an Intoxilyzer 5000 indicated that defendant's blood alcohol level was .170 grams per cent. After a bench trial, she was convicted of both offenses.
