The agreement between the plaintiff Sam Jacobs, Sr., and the defendants Profile Records, Inc., and Protoons Publishing, Inc. (hereinafter collectively Profile), allowed Profile to contract directly with singer Dana McCleese in the event that the plaintiff defaulted on his agreement with Profile.
