Defendant was indicted for two counts of criminal possession of a weapon in the third degree after he was found in possession of a loaded 9 millimeter automatic pistol on September 22, 1995. A hearing was held on defendant's motion to suppress the gun, at which Police Officers O'Keefe, Cuadrado and O'Sullivan testified for the People.
