Defendants Hess Oil Virgin Islands Corp. ["HOVIC"] and United Steelworkers of America, AFL-CIO-CLC, ["USWA"] seek to dismiss plaintiff Calvin K.R. McCoy's ["McCoy"] complaint for failure to state a claim. As explained below, the Court will deny the defendants' motions.
