Upon the refusal of the defendant to rent an apartment to the plaintiff, the plaintiff filed a multi-count complaint in the Housing Court claiming that the defendant's refusal was based upon the fact that the plaintiff was black and a recipient of public assistance. In his complaint, he alleged the following claims: a violation of G. L. c. 151B, § 4, sixth par., as in effect prior to St. 1989, c. 516, § 9, based on the asserted discriminatory...
