No. 98-41129.

199 F.3d 193 (1999)

UNITED STATES of America, Plaintiff-Appellee, v. Cecil Anthony DORTCH, Defendant-Appellant.

United States Court of Appeals, Fifth Circuit.

December 23, 1999.

Attorney(s) appearing for the Case

David Haskell Henderson, Jr. (argued), Asst. U.S. Atty., Beaumont, TX, for Plaintiff-Appellee.

Denise S. Benson (argued), Beaumont, TX, Amy R. Blalock, Tyler, TX, for Defendant-Appellant.

Before GARWOOD, SMITH and BENAVIDES, Circuit Judges.

JERRY E. SMITH, Circuit Judge:

Cecil Dortch appeals his conviction of possession with intent to distribute cocaine in violation of 21 U.S.C. § 841(a)(1). He challenges the denial of his motion to suppress evidence, the sufficiency of the evidence, and the denial of his motion to proceed pro se. Concluding that the inculpatory evidence was the fruit of an illegal search, we reverse and remand for entry of a judgment of acquittal.
