The Texas Department of Public Safety ("the Department") appeals a judgment reversing the suspension of appellee Anthony Tyrone Jennings's driver's license. Following a hearing by the State Office of Administrative Hearings, an administrative law judge ("ALJ") upheld the suspension of Jennings's license.
