The pro se plaintiff, David C. Tucker ("Tucker" or the "plaintiff"), initiated two lawsuits, consolidated under Docket Number 96 CV 1098, pursuant to 42 U.S.C. § 1983. In a prior decision, the Court observed that is difficult to discern the grounds for the two lawsuits, which are set forth in nearly verbatim complaints.
