OPINION ON REHEARING

PER CURIAM.

This court affirmed the conviction of appellant William Christopher Schoels for first-degree murder with use of a deadly weapon and possession of a firearm by an ex-felon. Schoels v. State, 114 Nev. 981, 966 P.2d 735 (1998). Schoels has petitioned for rehearing.

We conclude that the petition has merit on one ground.
