PER CURIAM.

Emanuel Nugent, a seventy-three year old man, was attacked by assailants and robbed of his wallet when he went to a convenience store in September 1997. During the struggle, he was knocked to the ground and struck the pavement face first. Nugent sustained injuries to his face, right leg, knee, and rib cage.
