Following a plea of not guilty, Larry Ray James was convicted by a jury of the offense of Driving While Intoxicated, subsequent offense. See TEX. PEN.CODE ANN. §§ 49.04(a) & 49.09(b) (Vernon Supp. 1999).1 Punishment was assessed by the jury at five years confinement in the Institutional Division of the Texas Department of Criminal Justice.
