Appellant, RHS Interests, Inc. filed suit against appellee, 2727 Kirby Ltd. and other defendants as the result of a failed real estate deal, alleging claims of breach of contract, fraud, fraudulent inducement, and specific performance. Kirby moved for summary judgment on the specific performance claim. The trial court granted Kirby's motion for summary judgment and severed that claim from the remaining claims asserted by RHS.
