Appellant, Mark Raymond Riley, pled not guilty before a jury to the offense of driving while intoxicated, DWI. See TEX. PEN.CODE ANN. § 49.04 (Vernon 1994 & Supp.1999). He was convicted, and the trial court assessed punishment at 180 days confinement in the Harris County Jail, probated for one year, and a fine of $500.
