Appellant Gene Milligan sought injunctive and declaratory relief concerning his rights pursuant to an easement burdening land owned by his former spouse, appellee Marilisa Niebuhr. The trial court ruled that the easement was terminated by a final decree of divorce that awarded the burdened property to Ms. Niebuhr.
