LYONS, Justice.

On June 23, 1997, Michael A. Blackmon pleaded guilty to theft of property in the second degree, and the trial court sentenced him to two years' imprisonment. On July 27, 1997, Blackmon, through appointed appellate counsel, filed a motion to set aside or withdraw his guilty plea on the ground that his trial counsel had misrepresented to him the length of his sentence by assuring him that he would be released on the day he pleaded guilty.
