FITZSIMMONS, J.

The defendant, Meguel J. Deshotel, was charged by bill of information with driving while intoxicated (DWI), third offense, a violation of La.R.S. 14:98. The defendant filed a motion to quash, which was denied by the trial court. Subsequently, the defendant pled guilty, pursuant to State v. Crosby, 338 So.2d 584 (La.1976). Pursuant to a plea agreement, the defendant was sentenced to one year at hard labor....
