We withdraw our earlier opinion and judgment dated January 28, 1999, and substitute this one in its place. Mark Wilkerson appeals from the judgment in his divorce action against Kimberly Wilkerson. In two points of error, Mr. Wilkerson contends the trial court erroneously (1) imposed a constructive trust against his separate real property, and (2) awarded a money judgment to Ms. Wilkerson based upon a sum that was not an item of community property...
