STATEMENT OF THE CASE

¶ 1. Hardy filed this action in Harrison County Circuit Court on December 11, 1990, for injuries received from a slip and fall on May 23, 1990, at the D'Iberville, Mississippi, Kmart Store. On November 27, 1991, Kmart filed a motion for summary judgment. On October 20, 1992, the trial court entered an Order granting Kmart's motion for summary judgment and dismissed the action....
