The defendant-appellant, Richard Blackwell ("Blackwell"), entered a guilty plea in the Superior Court to one count of Delivery of a Narcotic Schedule II Controlled Substance. He was sentenced, inter alia, to fifteen years of minimum mandatory incarceration at Level V. Blackwell did not file a direct appeal. He did, however, file a motion to withdraw his guilty plea.
