Appellant, state, timely appeals an order granting the motion of appellee, James Manney, to suppress.

This case arose when appellant charged appellee with four counts of DUI manslaughter and with four counts of vehicular homicide. Appellee filed a motion to suppress hospital records obtained by Trooper Scott Walter without a subpoena and notice to him.
