The affirmation of the trial court conviction and sentence of Ricky Fugler is considered by this court pursuant to the grant of a rehearing. Ricky Fugler was charged by grand jury indictment with one count of attempted first degree murder, a violation of La. R.S. 14:27 and La. R.S. 14:30. He pled not guilty.
