Linh Ngoc Bui was convicted of assault in the first degree after the trial court instructed the jury that a person is an accomplice in a crime if he acts with knowledge that his action will promote a crime and not the crime as the statute requires. This allowed the State to argue to the jury that it could find Bui was an accomplice to first degree assault so long as he acted with knowledge that his actions would promote or facilitate the commission...
