On 28 March 1996, defendant was charged by grand jury indictment with second degree murder; to which he pled not guilty. The trial court denied defendant's motion to suppress the identification on 24 October 1996; and, on 18 and 20 February 1997, defendant was tried by a twelve-member jury and found guilty as charged.
