FACTS AND PROCEDURE

[¶ 1.] A complaint was filed against Eugene Jemison (Jemison) on November 13, 1997, charging him with one count of burglary in the fourth degree and one count of false impersonation. Jemison was indicted on these charges by a Minnehaha County Grand Jury on November 26, 1997. He was arraigned on December 4, 1997, at which time he entered pleas of not guilty to both charges. A jury trial was held on March 10, 1997...
