ORDER

The judgement of this court, 136 F.3d 610, is reversed and the case is remanded to the district court for further proceedings consistent with the decision of the Supreme Court of the United States in El Paso Natural Gas Co., et al. v. Neztsosie, et al., 526 U.S. ___, 119 S.Ct. 1430, 143 L.Ed.2d 635 (1998).
