OPINION

Opinion by Justice GRANT.

William R. Marable appeals his conviction for delivery of a controlled substance, cocaine of less than one gram. Marable was charged by indictment1 for actual delivery of a controlled substance and pleaded not guilty. A jury found Marable guilty, and the trial court sentenced him to twenty months in the State Jail Division of the Texas Department of Criminal Justice.
