EAKIN, J.:

¶ 1 Edward Arnold Kisner, charged with attempted rape, attempted involuntary deviate sexual intercourse (IDSI), indecent assault, unlawful restraint and terroristic threats, waived his right to a jury. Convicted of all charges, the judge sentenced him to six to twelve years imprisonment for attempted rape, and five years consecutive probation for attempted IDSI; no penalty was imposed for the remaining convictions.
