Defendant, Willie F. Curtis, appeals from his conviction of possession of cocaine with intent to distribute. We affirm and remand.

On December 19, 1997, defendant was charged with one count of possession of cocaine, a violation of La. R.S. 40:967(C). He pled not guilty on January 5, 1998.
