CARAWAY, J.

A jury convicted the defendant, Christopher Lee, of illegal use of a weapon during a crime of violence (aggravated assault), a violation of La. R.S. 14:94(F). The trial court then sentenced defendant to the mandatory statutory minimum of ten years imprisonment at hard labor without benefit of parole, probation or suspension of sentence.
