This case came before the Court on January 25, 1999, pursuant to our order directing the parties to appear and show cause why the plaintiffs motion to dismiss the defendant's appeal should not be summarily decided. After consideration of the parties' legal memoranda and oral argument by their counsel, we conclude that cause has not been shown and we proceed to summarily decide the timeliness of the defendant's appeal that is raised by the plaintiffs motion...
