ORDER

LEONARD, District Judge.

On July 20, 1998, petitioner filed this action for relief pursuant to 28 U.S.C. § 2241. Petitioner seeks release from his continuing detention by the Immigration and Naturalization Service ("INS") pending deportation; he has been in the custody of the INS since November 8, 1996. Pursuant to 28 U.S.C. § 636(b), this matter was referred to the Honorable Valerie K. Couch for initial determination.
