This case is before this Court upon appeal of a final order of the Circuit Court of Cabell County entered on July 31, 1998. Pursuant to that order, the circuit court entered summary judgment in favor of the defendant, P.C. Emmons, in a negligence action filed by the plaintiffs, P. David and Winnie Boyer.
