POWERS, J.

Union Pacific Resources Company appeals from a judgment recovered by appellees Hellen Reasoner Hutchison, Milburn E. Nutt, and Susan McRae1 after a non-jury trial based on a set of agreed issues and stipulated facts. We will reverse in part the trial-court judgment and render judgment as set out below, affirming that part of the judgment not reversed.
