FACTS AND PROCEDURE

In the spring of 1995, Larry Fairfax performed work on property, as well as on a private road leading to the property, of Timothy and Christine Ramirez. The road, located upon an easement owned by the Ramirezes, crosses a number of neighboring parcels.
