In 1993, a jury found appellant Melvin Joseph Geary guilty of first degree murder with the use of a deadly weapon and sentenced him to death. This court affirmed his conviction, reversed his death sentence, and remanded for a new penalty hearing. In October 1998, another jury returned a sentence of death, and Geary subsequently informed the district court that he wanted to waive his direct...
